Terms of Service

These Terms govern your use of SwimIQ, the AI co-pilot for competitive swim coaches, operated by Arman Sanei in Toronto, Ontario, Canada. By creating an account or using the Service, you agree to these Terms.

1. Who we are

SwimIQ ("we", "us", "the Service") is operated by Arman Sanei, based in Toronto, Ontario, Canada. Contact: info@swimiq.ca.

2. The Service

SwimIQ is an AI-assisted tool that helps competitive swim coaches structure, analyze, and share workouts. Outputs are generated by third-party AI models and are intended as suggestions only — they are not professional, medical, athletic, or coaching advice. You are responsible for any training decisions you make based on SwimIQ output.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

4. Your account

You are responsible for keeping your password secure and for all activity under your account. Notify us immediately at info@swimiq.ca if you suspect unauthorized use.

5. Your content

Workouts, coach knowledge base entries, names, and any other content you upload remain your property. By using SwimIQ you grant us a limited license to store, process, and display that content solely to provide the Service to you and any coaches you authorize (e.g. assistants in your club).

7. Subscriptions and billing

Web (app.swimiq.ca): paid plans are billed monthly in CAD via our web payment processor. Each paid plan begins with a 7-day free trial that requires a valid payment method. If you do not cancel before the trial ends, your plan auto-renews and the first monthly charge applies. Subsequent charges renew on the same day each month until you cancel.

iOS: paid plans purchased through the iOS app are billed by Apple through In-App Purchase. Pricing, trial length (if any), renewal timing, and tax handling follow what is shown on the App Store purchase sheet at the time of purchase. Apple — not SwimIQ — is the merchant of record for iOS purchases.

Account-platform binding: SwimIQ accounts are locked to the billing platform on which they were created. An account created on the web is billed via our web payment processor and cannot switch to Apple/iOS billing; an account created in the iOS app is billed by Apple and cannot switch to web billing. We are unable to migrate a subscription between billing rails. To use a different billing platform you would need to cancel your current subscription and create a new SwimIQ account on the other platform.

8. Cancellation and account deletion

Cancel subscription (web): from Settings → Manage Subscription. Cancellation takes effect at the end of your current billing period — you keep full access until then.

Cancel subscription (iOS): from iOS Settings → Apple ID → Subscriptions. Apple does not allow us to cancel iOS subscriptions on your behalf. Cancellation takes effect at the end of the current Apple billing period.

Delete account (web): from Settings → Delete My Account. Deletion is immediate and irreversible. Any active web subscription is cancelled at the same moment, you lose access right away, and the unused portion of the current billing period is non-refundable. Your profile, workouts, knowledge base, club, and all other data are permanently erased. Use Cancel subscription instead if you want to use the rest of the time you paid for.

Delete account (iOS): deleting your SwimIQ account does not cancel an Apple subscription — Apple is the merchant of record and only Apple can stop the billing. You must cancel the subscription separately in iPhone Settings → Apple ID → Subscriptions → SwimIQ, otherwise Apple will continue charging your Apple ID for an account that no longer exists. To avoid this, cancel the Apple subscription first, wait for Apple to confirm, then delete your account.

9. Refunds

Web: subscriptions are non-refundable. No prorated refunds for partial months, downgrades, or unused time. For accidental double-charges or technical issues that prevented use of the Service, email info@swimiq.ca within 30 days of the charge and we will review in good faith.

iOS: iOS subscriptions are billed by Apple. Refund requests for iOS purchases must be submitted directly to Apple at reportaproblem.apple.com. SwimIQ cannot issue refunds for App Store purchases.

10. Termination by us

We may suspend or terminate your account if you breach these Terms, abuse the Service, or for legal compliance. We will give reasonable notice when possible.

11. AI output disclaimer

SwimIQ uses third-party AI providers to process workouts and voice input. AI output may be inaccurate, incomplete, or unsuitable for any particular swimmer. Always apply your own coaching judgment. SwimIQ is not liable for outcomes resulting from following AI suggestions.

12. Limitation of liability

To the maximum extent permitted by law, SwimIQ's total liability to you for any claim relating to the Service is limited to the fees you paid us in the 3 months immediately preceding the claim. We are not liable for indirect, incidental, or consequential damages.

13. Apple App Store terms (iOS only)

If you obtained SwimIQ from the Apple App Store, the following terms apply in addition to these Terms:

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario.
